Naming of Legal Entities In The Hands Of the Secretariat Of Economy
Please be advised that as of this past June 16, the power to authorize the use or change of the registered name or corporate name of legal entities was transferred from the Ministry of Foreign Affairs (Spanish: Secretaría de Relaciones Exteriores) to the Secretariat of Economy (Spanish: Secretaría de Economía, abbreviated SE) as a result of amendments to both the Foreign Investment Law and the Organic Law on Federal Public Administration.
That agency reported in a statement, "In order to optimize the process for starting-up a company, the Secretariat of Economy is developing a new computer service to address the procedures (paperwork and/or formalities) arising from its new conferred powers/function.”
Said service which does not postpone the transfer of the above-mentioned powers and authority will begin operations this coming September 17 and will include the option for processing the paperwork through the Internet, expeditiously and securely, using the electronic signatures known as "FIEL" (issued by the Mexican Tax Administration Service) and "FEA" (issued by the very Secretariat of Economy).
Until the foregoing is finalized, the Ministry of Foreign Affairs will provide its facilities and computer system to the Secretariat of Economy for three months in order to give continuity to the services rendered with the same quality standards just like before.
During this transition period, personnel commissioned by the Ministry of Foreign Affairs will train the Secretariat of Economy personnel on the receiving and handling procedures (paperwork and/or formalities) for authorizing the use of the registered name or corporate name in setting up corporations, as well as authorizing the change of the registered name or corporate name of same.
